John Burke, who lived alone behind the Strathmerton publish workplace in northern Victoria, would typically pop all the way down to a neighborhood service station to talk to the attendant for firm within the evenings.
But he was fatally attacked within the early hour of August 8, 2021 by Troy Maskell, who hit him over the top with a one-litre bottle and kicked him on a tough tile flooring.
Maskell’s girlfriend had falsely accused Burke of being a paedophile.
Burke died in hospital 11 weeks after the assault.
A jury returned a responsible verdict in opposition to 44-year-old Maskell on Monday morning after a trial within the Victorian Supreme Court.
Jurors had heard Burke had smiled and requested Maskell’s girlfriend and their daughter how they have been after they entered the service station that night time.
The 10-year-old replied that she was good earlier than her mom jumped in with the wrongful accusation, adopted by aggression and abuse.
“I’ll rape you,” the girl informed Burke, who was attempting to maintain his distance, earlier than Maskell entered and requested if there was an issue.
Maskell picked up a bottle of sports activities drink and hurled it on the 73-year-old’s head then kicked him within the hip, inflicting him to fall to the ground.
He stomped on Burke’s glasses, walked away and returned to kick him once more.
Burke was acutely aware and in ache when paramedics arrived.
He was taken to the native Goulburn Valley hospital after which urgently transferred to the Royal Melbourne Hospital when blood clots have been found on his mind.
He died on October 28 from a mind harm.
Maskell informed police the night time was blurry and that he had been ingesting.
His lawyer Julia Munster had claimed Maskell was not accountable for Burke’s loss of life and his actions have been “not objectively dangerous”.
“His actions, while shameful, stupid and unlawful … did not cause Burke’s death,” she mentioned.
